DIGEST AND PURPOSE 

H.B. 53 authorizes the governor to designate the presiding officer of the
governing boards or commissions of most state agencies and institutions of
higher education.  

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 651, Government Code, by adding Section
651.010, as follows: 

Sec. 651.010.  APPOINTMENT OF PRESIDING OFFICERS BY GOVERNOR.  (a) Defines
"state agency." 

(b) Authorizes the governor, notwithstanding other law, to designate a
member of the governing body of each state agency as the presiding officer
of that governing body to serve in that capacity at the pleasure of the
governor. 

(c) Provides that this section does not apply to certain state agencies,
certain entities, certain river authorities, or a junior college district. 

SECTION 2.  Effective date: November 1, 2003.
