H.B. 59 78(1) BILL ANALYSIS H.B. 59 By: Casteel Government Reform Committee Report (Unamended) BACKGROUND AND PURPOSE Current law provides that the Governor must deliver a budget to the Legislature by the sixth day of each regular legislative session or face criminal penalty. HB 59 provides the Governor additional time to provide the budget and repeals the criminal penalty. Additionally, HB 59 eliminates duplication through repealing the Governor's report on Organization and Efficiency of State Agencies. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any rulemaking authority to a state officer, department, agency, or institution. ANALYSIS SECTION 1. Amends Section 401.0445(b)(2), Government Code, by requiring the governor to show in the budget the expenditures for the year preceding the current year instead of the expenditures for each of the two full years preceding the current year. SECTION 2. Amends Section 401.046(a), Government Code, by increasing the time requirement for the governor to provide a budget to the legislature from no later than the sixth day of each regular legislative session to no later than when the governor gives the constitutionally required message to the legislature at the commencement of each regular legislative session. SECTION 3. Repeals Section 401.047 and Chapter 2053, Government Code. SECTION 4. Effective Date. EFFECTIVE DATE This Act takes effect November 1, 2003.
