H.B. 65 78(1) BILL ANALYSIS H.B. 65 By: Gallego Government Reform Committee Report (Unamended) BACKGROUND AND PURPOSE Currently, Section 2152.051, Government Code, states that the Texas Building and Procurement Commission Board shall consist of (1) three members appointed by the governor; (2) two additional members appointed by the governor from a list of nominees submitted by the speaker of the house of representatives; and (3) two members appointed by the lieutenant governor. This bill changes that by stating that the commission consists of five members appointed by the governor. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Amends Section 2152.051, Government Code. Currently, Section 2152.051, Government Code, states that the Texas Building and Procurement Commission Board shall consist of (1) three members appointed by the governor; (2) two additional members appointed by the governor from a list of nominees submitted by the speaker of the house of representatives; and (3) two members appointed by the lieutenant governor. This bill changes that by stating that the commission consists of five members appointed by the governor. This section governs the composition of the commission after January 31, 2007. On or before that date, this Subsection B governs the composition of the commission. Subsection B states that the commission consists of seven members, of whom three members are appointed by the governor, two additional members are appointed by the governor from a list of nominees submitted by the speaker of the house of representatives, and two members are appointed by the lieutenant governor. The bill stipulates that the members currently serving on the commission are entitled to serve out the terms for which they were appointed (assuming they are otherwise qualified for their positions). The bill also allows the Governor to appoint a member to fill a position on or before January 31, 2007, if the term of any position on the commission expires or a vacancy is created. However, the bill abolishes the two positions on the commission that are filled by appointment by the governor from a list submitted by the speaker on the expiration of the positions' terms on January 31, 2007. EFFECTIVE DATE November 1, 2003.
