H.B. 84 78(1) BILL ANALYSIS H.B. 84 By: Grusendorf Appropriations Committee Report (Unamended) BACKGROUND AND PURPOSE An $800 million delay in foundation School Program payments was passed by the 78th Legislature as a one-time savings. The delay, when it was originally drafted in H.B. 5 and H.B. 3459, would have pushed the August 2004 payment in to September 2004, reducing the amount of cash needed to finance the fiscal 2004 budget. Subsequently, H.B. 2425 created some confusion since it called for immediate effect. The intent of this bill is to clarify the effective date of the delayed payment. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Limits provisions found in HB 2425 and HB 3459 passed in the 78th Legislature to apply only to a payment from the foundation school fund that is made on or after January 1, 2004. Payments made before that date are governed by Section 42.259, Education Code, as it existed on June 1, 2003, and the former law is continued in effect for this purpose. EFFECTIVE DATE Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect on the 91st day after the last day of the legislative session.
