SRC-AMY S.B. 43 78(1) BILL ANALYSIS Senate Research Center S.B. 43 By: Ogden Infrastructure Development and Security 7/11/2003 As Filed DIGEST AND PURPOSE H.B. 3588, 78th Regular Session of the Texas Legislature, provided for an additional $1 motor vehicle registration fee applicable to vehicles for which the owner is required to submit evidence of financial responsibility at the time of registration. When a motor vehicle dealer sells a motor vehicle, the dealer is require to submit an application for title and registration, but is exempt from the requirement to submit proof of financial responsibility at that time, and therefore exempt from the additional fee. Consequently, the Texas Department of Transportation may incur significant additional programming costs without a commensurate return. As proposed, S.B. 43 applies the additional fee to dealer transactions in the same manner that it is applied to transactions by nondealers. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 502.1715(a), Transportation Code, to require the applicant, in addition to other fees imposed for registration of a motor vehicle, at the time of application for registration or renewal of registration of a motor vehicle that is subject to Section 501.0234 (Duty of Vehicle Dealer on Sale of Certain Vehicles), to pay a fee of $1. SECTION 2. Effective date: upon passage or November 1, 2003.
