A BILL TO BE ENTITLED
AN ACT
relating to automatic admission to an institution of higher
education.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 51.803, Education Code, is amended by
adding Subsection (c) to read as follows:
(c) A general academic teaching institution is not required
to fill more than 50 percent of the institution's total number of
spaces available for first-time resident undergraduate students at
the institution through the admission of applicants under
Subsection (a). If the number of applications for admission under
Subsection (a) received by the institution exceeds 50 percent of
the total number of spaces available for first-time resident
undergraduate students at the institution, the institution may give
automatic admission as provided by this section to those applicants
until 50 percent of the institution's total number of spaces
available for first-time resident undergraduate students are
filled. The institution shall consider the factors listed in
Section 51.805 to determine which of the remaining applicants under
Subsection (a) the institution will admit.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
