A BILL TO BE ENTITLED
AN ACT
relating to gas transportation service for a state agency. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 104.251, Utilities Code, is amended to read as follows: Sec. 104.251. GENERAL STANDARD. A gas utility shall furnish service, instrumentalities, and facilities that are safe, adequate, efficient, and reasonable. A gas utility may not require, as a condition for providing transportation services for a state agency, advance payment or charges for instrumentalities or facilities. A utility may recover any cost, less salvage value, for an instrumentality or facility only on a pro rata basis over the used and useful life of the instrumentality or facility. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect on the 91st day after the last day of the legislative session.
