A BILL TO BE ENTITLED
AN ACT
relating to the filing of a lien against the home of certain Medicaid recipients. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 531.077, Government Code, as added by Section 2.17, H.B. No. 2292, Acts of the 78th Legislature, Regular Session, 2003, is amended by adding Subsection (c) to read as follows: (c) The state may not file a lien under this section against the residence homestead of a recipient of medical assistance under Chapter 32, Human Resources Code, if: (1) the recipient receives an exemption under Section 11.13, Tax Code, for the residence homestead; and (2) the market value of the residence homestead, according to the most recent certified appraisal roll for the county in which the property is located, is not greater than $150,000. SECTION 2. This Act takes effect September 1, 2003, if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for effect on that date, this Act takes effect on the 91st day after the last day of the legislative session.
