H.B. 3 78(2) BILL ANALYSIS H.B. 3 By: Swinford Government Reform Committee Report (Unamended) BACKGROUND AND PURPOSE Current law provides that the Governor must deliver a budget to the Legislature by the sixth day of each regular legislative session or face criminal penalty. HB 3 provides the Governor additional time to provide the budget and repeals the criminal penalty. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any rulemaking authority to a state officer, department, agency, or institution. ANALYSIS SECTION 1. Amends Section 401.046(a), Government Code by striking language that required the Governor to submit his budget to the legislature by the sixth day of each legislative session. Instead the Governor would be required to submit his budget prior to giving the State of the State Address. SECTION 2. Section 401.047, Government Code is repealed. This is the criminal penalty associated with failure of the Governor to submit his budget to the legislature. SECTION 3. Effective Date. EFFECTIVE DATE This Act will take effect December 1, 2003.
