H.B. 13 78(2) BILL ANALYSIS H.B. 13 By: Swinford Government Reform Committee Report (Unamended) BACKGROUND AND PURPOSE Currently, the Texas Commission on Environmental Quality is required by law to produce several reports on various issues. This includes, but is not limited to, a report on waste reduction as prescribed by Section 363.064 (a), Health and Safety Code. HB 13 repeals certain statutes that create burdensome reporting requirements for the Texas Commission Environmental Quality. Furthermore, HB 13 creates a committee to study the permitting process at TCEQ. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS HB 13 repeals certain statutes of the Health and Safety Code and the Water Code that create burdensome reporting requirements for the Texas Commission on Environmental Quality. HB 13 creates a seven member study committee to study the permitting process at the Texas Commission on Environmental Quality. The committee will consist of three appointees of the Lieutenant Governor, three appointees of the Speaker of the House, and one public member appointed by the Governor. EFFECTIVE DATE December 1, 2003.
