A BILL TO BE ENTITLED

AN ACT

relating to the prosecution of the offense of trespass by the holder 
of a license to carry a concealed handgun.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 30.06(e), Penal Code, as added by Senate 
Bill No. 501, Acts of the 78th Legislature, Regular Session, 2003, 
is amended to read as follows:
	(e)  It is an exception to the application of this section 
that the property on which the license holder carries a handgun is 
owned or leased by a governmental entity and is not:
		(1)  a premises or other place on which the license 
holder is prohibited from carrying the handgun under Section 46.03 
or 46.035; or
		(2)  the premises of a city hall.                                      
	SECTION 2.  (a)  This Act takes effect December 1, 2003.                       
	(b)  The change in law made by this Act applies only to an 
offense committed on or after December 1, 2003.  An offense 
committed before December 1, 2003, is covered by the law in effect 
when the offense was committed, and the former law is continued in 
effect for that purpose.  For purposes of this subsection, an 
offense was committed before December 1, 2003, if any element of the 
offense was committed before that date.
