A BILL TO BE ENTITLED
AN ACT
relating to the authority of the secretary of state to modify the
filing period and related dates for the March 2004 primary
elections for congress.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. To allow for the primary elections for the
congressional districts enacted in H.B. No. 1, Acts of the 78th
Legislature, 2nd Called Session, 2003, including any changes made
to those districts as a result of court action or subsequent
legislation, to be held on the first Tuesday in March 2004, the
secretary of state may modify the deadline for filing an
application by a candidate for the United States House of
Representatives for a place on the general primary election ballot
and any other deadlines or procedures relating to the holding of
congressional primary elections on that date.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect on the 91st day after the last day of the
legislative session.
