Amend CSHB 3 in Article III by adding the following appropriately numbered SECTION and renumbering the other SECTIONS of Article III accordingly: SECTION ____. (a) In any action in state or federal court involving a legal challenge to one or more districts established by this Act, or in an action to obtain preclearance under Section 5 of the Voting Rights Act of 1965 (42 U.S.C. Sec. 1973c) of the districts established by this Act, the attorney general may not retain or employ an attorney to represent this state or an officer of this state or to assist or advise the attorney general in that representation, if: (1) the state or the state officer takes the position in that action that the districts established by this Act are lawful, should be precleared, or should be used to elect United States Representatives; or (2) the attorney was previously retained or employed by the attorney general to represent this state or an officer of this state, or to assist or advise the attorney general in that representation, in an action in state or federal court in which the state or the state officer filed any motion, brief, or pleading supporting or approving the use of the congressional districts ordered by the court in Balderas v. State, No. 6:01CV158, (PLAN 1151C in the Texas Legislative Council redistricting computer system) for the 2002 general election.
