SRC-JBJ H.B. 23 78(3) BILL ANALYSIS Senate Research Center H.B. 23 78S30148 JMM-DBy: Capelo (Bivins) Finance 9/18/2003 Engrossed DIGEST AND PURPOSE The Office of Patient Protection within the Health Professions Council was created by H.B. 2985, 78th Legislature, Regular Session, 2003. While fees were established and will be collected, no appropriation was made to the Health Professions Council for the operation of the program. H.B. 23 appropriates the fees collected under H.B. 2985 to the Health Professions Council for the administration of the Office of Patient Protection. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. (a) Provides that all fees collected during the state fiscal biennium beginning September 1, 2003, authorized by Subchapter G (Office of Patient Protection), Chapter 101, Occupations Code, as added by Chapter 305, Acts of the 78th Legislature, Regular Session, 2003, are appropriated to the Health Professions Council for the state fiscal biennium beginning September 1, 2003, for the administration of the office of patient protection under Subchapter G, Chapter 101, Occupations Code. (b) Requires any increase in state employee benefit costs incurred during the state fiscal biennium beginning September 1, 2003, in connection with administering Subchapter G, Chapter 101, Occupations Code, as added by Chapter 305, Acts of the 78th Legislature, Regular Session, 2003, to be paid out of the appropriations made by Subsection (a) of this section and to be allocated to the appropriate employee benefit appropriation items in accordance with applicable rules of the comptroller. SECTION 2. Effective date: upon passage or January 15, 2004.
