BACKGROUND AND PURPOSE 

H.B. 2985, 78th Legislature, Regular Session, created the Office of
Patient Protection within the Health Professions Council. While fees were
established and will be collected, no appropriation  was made to the
Health Professions Council for the operation of the program. H.B. 23
appropriates the fees collected under H.B. 2985 to the Health Professions
Council for the administration of the Office of Patient Protection. 


RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency, or
institution.   

ANALYSIS

H.B. 23 appropriates fees collected under H.B. 2985, 78th Legislature,
Regular Session, as authorized by subchapter G, Chapter 101, Occupations
Code, to the Health Professions Council for the purpose of the
administration of the Office of Patient Protection. 

H.B. 23 requires any increase in state employee benefit costs incurred
under subchapter G, Chapter 101 of the Occupations Code to be covered by
the  appropriation made in this bill. 


EFFECTIVE DATE

Immediate effect if it receives a vote of two-thirds of all members
elected to each house. If this act does not receive the vote for immediate
effect, the act takes effect January 15, 2004.
