H.B. 25 78(3) BILL ANALYSIS H.B. 25 By: Heflin Appropriations Committee Report (Unamended) BACKGROUND AND PURPOSE The 78th Legislature, Regular Session enacted Section 161.0411 of the Agriculture Code, providing for the registration of sellers, distributors, or transporters of live domestic or exotic fowl in Texas. The Texas Animal Health Commission is charged under this act with establishing fees for its enforcement. The purpose of House Bill 25 is to appropriate fees collected by the Texas Animal Health Commission under the Section 161.0411, Agriculture Code [domestic and exotic fowl registration program], to the commission for administration of that section. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS H.B. 25 appropriates all fees collected beginning September 1, 2003 under Section 161.0411, Agriculture Code, to the Texas Animal Health Commission for the administration of that section. H.B. 25 requires any increase in state employee benefit costs incurred under Section 161.0411 of the Agriculture Code to be covered by the appropriation in this bill. EFFECTIVE DATE Immediate effect if it receives a vote of two-thirds of all members elected to each house. If this act does not receive the vote for immediate effect, the act takes effect on the 91st day after the last day of the legislative session.
