A BILL TO BE ENTITLED

AN ACT

relating to the membership of the electric utility restructuring 
legislative oversight committee.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Sections 39.907(b) and (h), Utilities Code, as 
amended or added by Section 12 of Senate Bill No. 1418 and Section 1 
of House Bill No. 1948, Acts of the 78th Legislature, Regular 
Session, 2003, are reenacted and amended to read as follows:
	(b)  The committee is composed of six members as follows:                      
		(1)  the chair of the House Committee on Regulated 
Industries [State Affairs];
		(2)  three members of the senate appointed by the 
lieutenant governor; and  
		(3)  two members of the house of representatives 
appointed by the speaker of the house of representatives.
	(h)  The chair of the House Committee on Regulated Industries
[State Affairs] and one of the members of the senate serving on the 
committee, designated by the lieutenant governor, shall serve as 
joint chairs of the committee.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect on the 91st day after the last day of the 
legislative session.
