A BILL TO BE ENTITLED

AN ACT

relating to the application of the sunset review process to certain  
rapid transit authorities.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter J, Chapter 451, Transportation Code, 
is amended by adding Section 451.453 to read as follows:
	Sec. 451.453.  REVIEW OF CERTAIN AUTHORITIES BY SUNSET 
ADVISORY COMMISSION.  An authority in which the principal 
municipality has a population of more than 1.2 million is subject to 
review under Chapter 325, Government Code, as if the authority were 
a state agency subject to that chapter, but the authority is not 
abolished under that chapter.  The authority shall be reviewed 
during the period in which state agencies scheduled to be abolished 
in 2005 and every 12th year after that year are reviewed.
	SECTION 2.  Before the 60th day after the date on which this 
Act takes effect, a rapid transit authority that is to be reviewed 
before September 1, 2005, by the Sunset Advisory Commission under 
Section 451.453, Transportation Code, as added by this Act, shall 
report to the commission the information required by Section 
325.007, Government Code.
	SECTION 3.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect on February 1, 2004.
