A BILL TO BE ENTITLED
AN ACT
relating to the use of state and local tax revenues to pay student expenses at private schools. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 4, Education Code, is amended by adding Section 4.004 to read as follows: Sec. 4.004. USE OF TAX REVENUES FOR PRIVATE SCHOOL EXPENSES PROHIBITED. (a) To ensure that the state has sufficient funds to provide a public education system as required by Section 1, Article VII, Texas Constitution, and Section 4.003 and that the public education system has sufficient funds to meet the mission, objectives, and academic goals specified by Sections 4.001 and 4.002, state or local tax revenues may not be used, directly or indirectly, to pay for any portion of a student's tuition, fees, or other expenses at a private elementary or secondary school. (b) Notwithstanding Subsection (a), state funds may be used to pay administrative costs under Section 31.028(c). SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect on the 91st day after the last day of the legislative session.
