No fiscal implication to the State is anticipated.

The bill would amend Section 1305.002 of the Occupations Code by adding Subdivision (1-a).  The subdivision would define "agricultural use" as a use or activity involving agriculture, as it is currently defined by Section 11.002, Water Code, other than the processing of an agricultural commodity.  The bill would also amend Section 1305.003(a) and Section 1305.161 of the Occupations Code.

 

The Department of Licensing and Regulation indicates the provisions of this bill could be implemented within current resources. 

 

The bill takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution; otherwise, the bill would take effect September 1, 2004.
