Amend Amendment No. 186 by Kolkhorst to CSHB 1 (amendment 
package page 214) by striking the current text of the amendment and 
substituting:
	Amend CSHB 1 in Rider No. 50 under the Article II 
appropriations to the Texas Department of Mental Health and Mental 
Retardation (page II-90) add the following at the end of the rider:
	If the department closes a state school, for each resident of 
that state school who resides in the state school at the time the 
closure is planned, the department must provide for state school 
placement for the resident unless:
		(1) the resident has the capacity to make a decision 
regarding the resident's placement, and the resident chooses not to 
be provided placement in a state school; or
		(2) the resident's legally authorized representative 
chooses not to have placement provided for the resident at a state 
school.
