Amend amendment No. 279 by Menendez to CSHB 1 (page 326, 
amendment packet), as follows:
	(1) Strike line 24 and substitute the following:                               
	(5) In Article III, add the following appropriately numbered 
rider after the Article III appropriations to the Texas Education 
Agency:
	_____. CONTINGENT ADDITIONAL FOUNDATION SCHOOL 
PROGRAM-EQUALIZED OPERATIONS FUNDING.  The Teacher Retirement 
System shall transfer, through an interagency contract, an amount 
of $442,600,000 from Strategy A.3.1 Active Health, to the Texas 
Education Agency, Strategy A.1.1 FSP-Equalized Operations, for the 
school employee pass-through.  School districts shall use 100 
percent of those transferred funds to pay for the annual $1,000 
health coverage or compensation supplements under Article 3.50-8, 
Texas Insurance Code.  School districts shall use up to 80 percent 
of funds made available to districts to implement HB 5 or similar 
legislation of the 78th Legislature and not more than 80 percent of 
funds made available to districts by any other increases in 
foundation school fund formulas for purposes of Chapter 41 or 42, 
Education Code, to pay the balance of the annual health coverage or 
compensation supplement under Article 3.50-8, Texas Insurance 
Code, of not more than $1,000 for each public school employee.  In 
the event that the funds identified by this Rider are not sufficient 
to provide a total of $1,000 annually for each public school 
employee, school districts shall prorate the amount for each 
employee proportionately.  The provisions of this Rider are 
contingent on the passage of legislation in the 78th Legislature 
implementing the changes described in this Rider.
	(6) Adjust total and methods of financing appropriately.
