Amend CSHB 4 as follows:                                                     
	On page 94, line 7-10, strike section (b) and insert a new 
section to read as follows:
	Section 74.0241(b)                                                             
	Notwithstanding any other law or rule, and on motion of a 
party to a health care liability claim, the supreme court shall 
assign a judge for the health care liability claim and any action or 
suit that includes the claim.  A motion to assign a judge must be 
made:
		(1) by a party asserting a claim not later than 10 days 
following the appearance of any defendant; or
		(2) by a party against whom the claim is asserted 
concurrently with or before the filing of the movant's answer.
