Amend CSHB 4 as follows:                                                     
	On page 3, between lines 8 and 9, insert a new subsection (d) 
to read as follows:
	(d)  The court may not abate or dismiss a claim for failure to 
exhaust administrative remedies if the abatement or dismissal 
would:
		(1)  result in a risk to public health or safety, or                          
		(2)  cause irreparable harm to the members of the class.
