Substitute for the Goodman amendment the following:                          
	Amend CSHB 4 on page 12, between lines 26 and 27, by 
inserting:              
	(e) This chapter does not apply to an action:                           
		(1) on a contract that specifies remedies for breach, 
including specific performance, liquidated damages, or attorney's 
fees;
		(2) on a negotiable instrument; or                                     
		(3) for a debt, including an action on a sworn account 
or for services rendered.
