Amend CSHB 4 as follows:                                                     
	On page 27, between lines 14 and 15, add a new Section 4.01 of 
the bill to read as follows and renumber accordingly:
	SECTION 4.01 Section 33.001, Civil Practices and Remedies 
Code is amended to read as follows:
	In an action to which this chapter applies, a claimant may not 
recover damages if his percentage of responsibility is greater than 
50 percent.  This chapter does not apply to an action in which the 
harm was caused by reckless, willful, wanton or intentional 
conduct.
