Amend CSHB 4 as follows:                                                     
	On Page 34, Line 2, strike the word "or"                                       
	On Page 34, Line 2, insert a new subsection 2 to read as 
follows and renumber current subsection (2) as subsection (3):
		(2)  an action in which the act or omission of the 
defendant, that is the basis of the action, is alleged to have been 
done intentionally or with malice, willful or wanton negligence or 
fraud;
