Amend CSHB 54 as follows:
(1) Add the following appropriately numbered SECTION to the bill and renumber subsequent SECTIONS of the bill accordingly:
SECTION ____. Chapter 86, Election Code, is amended by
adding Section 86.0031 to read as follows:
Sec. 86.0031. BALLOTING MATERIALS RECEIVED BY CERTAIN MAIL
SERVICES. (a) In this section, "commercial mail receiving agency"
means a person other than the United States Postal Service who, for
compensation, accepts the delivery of mail for another person and
holds the mail for collection by the person or forwards the mail to
a different address.
(b) A commercial mail receiving agency shall record for each
ballot accepted by the agency:
(1) the name of the person to whom the ballot is
addressed; and
(2) the following information:
(A) if the agency forwards the ballot, the name
of the person to whom and the address to which the ballot is
forwarded; or
(B) if a person collects the ballot directly from
the agency, the name of the person collecting the ballot and whether
the person collecting the ballot is the person to whom the ballot is
addressed.
(c) If a person collects a ballot directly from a commercial
mail receiving agency, the agency shall obtain the signature of the
person collecting the ballot and shall retain the signature with
the information recorded under Subsection (b).
(d) A commercial mail receiving agency shall keep a record
of the information recorded under Subsection (b) and obtained under
Subsection (c). The agency shall provide the record to the
secretary of state on written request. This subsection does not
require a commercial mail receiving agency to keep or provide a
record of information after the second anniversary of the date the
information is recorded or obtained.
(e) A person may collect a ballot from a commercial mail
receiving agency only if the person provides to the commercial mail
receiving agency the person's name and signature and, if the person
collecting the ballot is not the person to whom the ballot is
addressed, the name of the person to whom the ballot is addressed.
(f) A commercial mail receiving agency commits an offense if
the agency does not obtain or record information as required by
Subsection (b) or (c) or fails to provide a record to the secretary
of state under Subsection (d). An offense under this subsection is
a Class C misdemeanor. Each ballot for which the agency fails to
obtain and record information constitutes a separate offense.
(2) On page 9, line 25, after "Service", insert "or of a
commercial mail receiving agency, as that term is defined by
Section 86.0031,".
