Amend HB 1365 on third reading as follows:                                   
	(1)  On page 1, line 4, strike "(h)" and substitute "(i)".                     
	(2)  On page 1, line 11, strike "[except as provided in 
Subsection (h)]" and substitute "except as provided in Subsection 
(i) [h]."
	(3)  On page 1, strike lines 17 through 24 and substitute:                     
	"(i)  The commission may consider, as an alternative method 
of compliance with the Texas low-emission diesel as described in 
revisions to the State Implementation Plan, [Subsection (h),] fuels 
to achieve equivalent emissions reductions.  The commission may 
adopt a rule to make such alternative methods enforceable.  If the 
commission has not approved alternative fuel strategies sufficient 
to replace the Texas low-emission diesel program as described in 
revisions to the State Implementation Plan for the control of ozone 
air pollution by June 1, 2004, the commission shall adopt fuel 
content standards for diesel fuel as necessary for compliance with 
federal air quality standards."
	(4)  Add a section appropriately numbered as follows:                          
	"Section _____.  Section 382.037(h), Health and Safety Code, 
is repealed."
