Amend HB 1743 as follows:
(1) On page 7, between lines 9 and 10, insert the following:
(d) With the consent of the appropriate local county or
district attorney, the attorney general has concurrent
jurisdiction with that consenting local prosecutor to prosecute an
offense under this section.
(2) Insert the following appropriately numbered sections
and renumber subsequent sections accordingly:
SECTION ___. Section 31.03, Penal Code, is amended by adding
Subsection (j) to read as follows:
(j) With the consent of the appropriate local county or
district attorney, the attorney general has concurrent
jurisdiction with that consenting local prosecutor to prosecute an
offense under this section that involves the state Medicaid
program.
SECTION ___. Section 32.45, Penal Code, is amended by adding
Subsection (d) to read as follows:
(d) With the consent of the appropriate local county or
district attorney, the attorney general has concurrent
jurisdiction with that consenting local prosecutor to prosecute an
offense under this section that involves the state Medicaid
program.
SECTION ___. Section 32.46, Penal Code, is amended by adding
Subsection (e) to read as follows:
(e) With the consent of the appropriate local county or
district attorney, the attorney general has concurrent
jurisdiction with that consenting local prosecutor to prosecute an
offense under this section that involves the state Medicaid
program.
SECTION ___. Section 37.10, Penal Code, is amended by adding
Subsection (i) to read as follows:
(i) With the consent of the appropriate local county or
district attorney, the attorney general has concurrent
jurisdiction with that consenting local prosecutor to prosecute an
offense under this section that involves the state Medicaid
program.
