Amend CSHB 3184 as follows:                                                  
	(1)  In SECTION 57 of the bill, amended Section 361.302, 
Transportation Code, on page 17, between lines 50 and 51 (committee 
printing), insert the following:
	"(d)  Money disbursed by the department under a comprehensive 
development agreement is not included in the amount:
(1)  required to be spent in a biennium for 
engineering and design contracts under Section 223.041; or
(2)  appropriated in Strategy A.1.1. 
Plan/Design/Manage of the General Appropriations Act for that 
biennium for the purpose of making the computation under Section 
223.041."
	(2)  In SECTION 57 of the bill, amended Section 361.302, 
Transportation Code (committee printing page 17, line 51), strike 
"(d)" and substitute "(e)".
	(3)  In SECTION 58 of the bill, added Section 361.3022(m), 
Transportation Code (committee printing page 19, line 7), strike 
"may" and substitute "shall".
	(4)  In SECTION 58 of the bill, added Section 361.3022(m), 
Transportation Code (committee printing page 19, line 19), insert, 
between "department" and "owns", "with the unsuccessful proposer 
jointly".
	(5)  In SECTION 58 of the bill, added Section 361.3022(m), 
Transportation Code (committee printing page 19, line 19), strike 
"exclusive".
	(6)  In SECTION 58 of the bill, strike Section 
361.3022(m)(2), Transportation Code (committee printing page 19, 
lines 23-24), and substitute the following:
"(2)  the use by the unsuccessful proposer of any 
portion of the work product contained in the proposal is at the sole 
risk of the unsuccessful proposer and does not confer liability on 
the department.".
