Amend CSSB 7 by adding the following section, appropriately
numbered, and renumbering the subsequent sections of the bill
appropriately:
SECTION ____. Subchapter B, Chapter 45, Family Code, is
amended by adding Section 45.107 to read as follows:
Sec. 45.107. CHANGE OF NAME AND VITAL STATISTICS
INFORMATION. (a) A court shall order a change of name for a
petitioner under this subchapter if the petition is accompanied by
a sworn affidavit of a licensed physician that the petitioner has
completed gender reassignment surgery.
(b) A court that orders a change of name for a petitioner
under this section shall simultaneously order that the Department
of Public Safety, on receipt of the court's order, change the
petitioner's name and gender on the petitioner's driver's license
and other identification documents under the department's control.
(c) The Texas Department of Health, on receipt of a
certified copy of the court's order under Subsection (a) and a
licensed physician's sworn affidavit that the petitioner has
completed gender reassignment surgery, shall:
(1) amend the petitioner's birth certificate as
provided by Section 192.011, Health and Safety Code, to reflect the
petitioner's corrected name and gender;
(2) register the petitioner's amended birth
certificate;
(3) send a copy of the petitioner's amended birth
certificate to the county or agency that filed the petitioner's
original birth certificate; and
(4) seal and, except as provided by court order or as
necessary for the department's processing purposes, prohibit
access to the petitioner's original birth certificate and any
correspondence, affidavits, court orders, or other documents
relating to that certificate that are under the department's
control.
(d) A county or agency that receives a copy of a
petitioner's amended birth certificate from the Texas Department of
Health under Subsection (c) shall destroy the petitioner's
original birth certificate and file the petitioner's amended
certificate.
