On page 8, strike lines 8-41 through page 12, line 12-13, and
substitute the following:
Sec. 1 For purposes of this article, "credit scoring" and
"insurance scoring" mean an underwriting guideline or rating factor
based in whole or in part on information related to an individual's
credit, credit worthiness, credit standing, credit capacity,
credit history, payment habits, or financial responsibility. The
terms include, but are not limited to, a numerical representation
of the insurance risk an individual presents, using the
individual's attributes derived from a credit report or credit
information or other information in a formula to assess insurance
risk on an actuarial or statistical basis.
Sec. 2 No person shall use an underwriting guideline or
rating factor based in whole or in part on credit scoring or
insurance scoring for personal automobile or residential property
insurance.
Sec. 3 A violation of this section constitutes an unfair
practice and unfair discrimination in the business of insurance in
violation of the Insurance Code, Articles 21.21 and 21.21-8, and
shall be subject to the provisions thereof.
