Amend CSSB 15 as follows:
(1) In SECTION 2 of the bill (commitee printing, page 1, line
19 through line 24), strike Subsection (a) and substitute the
following:
(a) The Texas Department of Economic Development may spend
money from the smart jobs fund for the purpose of making grants to
businesses or local governmental entities in connection with
providing incentives for businesses to locate an operation within
Texas. A business or local governmental entity that receives a
grant may spend the money to provide job training to the employees
of a business that locates in Texas, to develop transportation
infrastructure reasonably expected to help induce a business to
locate in Texas, and for other business location incentives. The
department shall adopt rules or develop procedures to implement
this Act.
(2) In SECTION 2 of the bill (committee printing, page 1,
between lines 24 and 25), add a new Subsection (b) to read as
follows and reletter subsections accordingly:
(b) A grant awarded under this section is contingent on the
recipient meeting certain criteria relating to the purposes for
which the grant is made. Before awarding a grant under this
section, the Texas Department of Economic Development must enter
into a written agreement with the business or local governmental
entity being awarded the grant specifying that:
(1) if all or any portion of the amount of the grant is
used to build infrastructure or make any other type of capital
improvement, the grant recipient must:
(A) retain a lien or other interest in the
capital improvement in proportion to the percentage of the grant
amount used to pay for the capital improvement; and
(B) ensure that if the capital improvement is
sold, the grant recipient repays the department, with interest at
the agreed rate and terms, any state money used to pay for the
capital improvement and shares with this state a proportionate
amount of any profit realized from the sale; and
(2) if the grant recipient fails to use an amount
awarded under this section for any of the purposes for which the
grant was intended, the recipient shall immediately repay that
amount and any related interest to this state the agreed rate and
terms.
(3) In SECTION 2(b) of the bill (committee printing, page 1,
lines 32 and 33), strike "for business location incentives" and
substitute "for the purpose of making a grant to one or more local
governmental entities to develop a rail line that is reasonably
expected to help induce a business to locate in Texas."
(4) In SECTION 2(c) of the bill (committee printing, page 1,
line 38), strike "for business location incentives" and substitute
"for the purpose of making a grant to one or more local governmental
entities to develop a rail line that is reasonably expected to help
induce a business to locate in Texas."
