Amend CSSB 104 by adding the following appropriately numbered
sections and renumbering the sections of the bill accordingly:
SECTION _____.Section 165.152(c), Occupations Code, is
amended to read as follows:
(c) An offense under Subsection (a) is a [Class A
misdemeanor, except that if it is shown in the trial of the offense
that the defendant has previously been convicted under Subsection
(a), the offense is a] felony of the third degree.
SECTION _____. The change in law made by this Act by the
amendment of Section 165.152(c), Occupations Code, applies only to
an offense committed on or after the effective date of this Act. An
offense committed before the effective date of this Act is covered
by the law in effect when the offense was committed, and the former
law is continued in effect for that purpose. For purposes of this
section, an offense was committed before the effective date of this
Act if any element of the offense occurred before that date.
