Amend CSSB 1176 (Senate committee printing) as follows: (1) In SECTION 1 of the bill, strike added Section 1251.002(a)(5), Occupations Code (page 2, lines 7-9), and substitute: (5) who collects less than $150,000 in profits per year from commercial or residential roofing as determined by the department. (2) In SECTION 1 of the bill, in added Section 1251.051, Occupations Code (page 2, between lines 25 and 26), insert a new Subsection (d): (d) The total fees charged to a license holder under this section may not exceed $200 per year. (3) In SECTION 1 of the bill, strike added Section 1251.103, Occupations Code (page 3, lines 15-25), and substitute a new Section 1251.103: Sec. 1251.103. APPOINTMENT. (a) The presiding officer of the commission shall appoint the advisory board members as follows: (1) three members must be full-time licensed roofing contractors with at least 10 years' experience in roofing contracting and must hold the following licenses: (A) one member must hold a commercial license; (B) one member must hold a residential license; and (C) one member must hold a commercial and a residential license; and (2) three members must be public representatives. (b) One member appointed under Subsection (a)(1) must be from a historically underutilized business. (4) Strike SECTION 2 of the bill (page 6, lines 16-49) and substitute a new SECTION 2 as follows: SECTION 2. (a) The Texas Department of Licensing and Regulation shall issue a roofing contractor license under Subchapter D, Chapter 1251, Occupations Code, as added by this Act, without an examination for the qualifying party if the qualifying party: (1) provides proof satisfactory to the department, on or before September 1, 2004, that the qualifying party: (A) has been engaged in the business of roofing contracting during the five years preceding the date of the license application; or (B) is, as of the date of the application, a certified roofing contractor in good standing as tested and approved by a roofing trade association recognized by the department, as shown by a copy of the contractor's certification attested to by the trade association; (2) applies to the executive director of the Texas Department of Licensing and Regulation not later than July 31, 2004; and (3) pays the required fee. (b) A person who is issued a license under this section and the qualifying party for that license holder are subject to all other provisions of Chapter 1251, Occupations Code, as added by this Act, including provisions for the renewal of the roofing contractor license.
