Amend CSSB 1374 by striking proposed Subsection 11.0237(a)
(committee printing page 2, lines 64-69; page 3, lines 1-4),
substituting the following, and renaming proposed Section 11.0237,
to read as follows:
Sec. 11.0237. PROCESSING OF WATER RIGHTS APPLICATIONS
DURING STUDY PERIOD. (a) In order to preserve options for
protecting environmental flows, the commission shall suspend
action on all applications for permits for new appropriations of
water for instream flows dedicated to environmental needs or bay
and estuary inflows and on all applications for new appropriations
for the use of 25,000 acre feet or more of water for consumptive
purposes. The commission may proceed with the processing of an
application for a new appropriation for the use of 25,000 acre feet
or more of water for consumptive purposes if the agency finds that
the processing of the application prior to the expiration date for
this section is necessary to address a water emergency. This
section does not prohibit the commission from issuing an amendment
to an existing permit or certificate of adjudication to change the
use to or add a use for instream flows dedicated to environmental
needs or bay and estuary inflows. This section does not apply to
any permit granted before the effective date of this section.
