Amend CSSB 1952 (Senate committee printing) by adding the 
following article and sections, numbered appropriately:
ARTICLE ____. LIQUID WASTES MANIFESTS
SECTION ____.01. Subchapter B, Chapter 361, Health and Safety Code, is amended by adding Section 361.034 to read as follows: Sec. 361.034. RECORDS AND MANIFESTS REQUIRED FOR CERTAIN LIQUID WASTES. (a) The commission by rule shall require a person who generates, collects, conveys, transports, processes, stores, or disposes of sewage sludge, water treatment sludge, domestic septage, chemical toilet waste, grit trap waste, or grease trap waste to keep records and use a uniform manifest as prescribed by commission rule to ensure that the waste is transported to an appropriate processing, storage, or disposal facility or site permitted or authorized for that purpose. (b) The rules must require the person who generates the waste, the person who transports the waste, and the person who disposes of the waste each to retain, for not less than three years, a copy of a transportation manifest that records the generator, transporter, and disposal site and method. (c) The rules must require that aggregate amounts of waste recorded on the manifests required under this section match the amounts of waste reported to the commission annually. The commission may require copies of manifests to be submitted with reports to the commission or at other times. SECTION ____.02. The Texas Commission on Environmental Quality shall adopt rules under Section 361.034, Health and Safety Code, as added by this Article, as soon as practicable so that the rules take effect not later than March 1, 2004. SECTION ____.03. This article takes effect immediately if this Act receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this article takes effect September 1, 2003.
