H.B. 43 78(R) BILL ANALYSIS H.B. 43 By: Chisum Environmental Regulation Committee Report (Unamended) BACKGROUND AND PURPOSE Currently there is a question of whether a person may serve on the Texas Council on Environmental Technology if that person is an employee or an owner of an entity that applies for a grant from the Council. HB 43 makes provision for that person to be able to serve on the Council by requiring that the person disclose the fact of employment by or ownership of an applying entity and not vote or participate in the awarding of a grant for that entity. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. . ANALYSIS SECTION 1. HB 43 adds Subsection (f) which requires a member of the Texas Council on Environmental Technology who is an employee or owner of an entity that applies for a grant to disclose that information otherwise the entity is not eligible for the grant. EFFECTIVE DATE If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003
