SRC-VRA C.S.H.B. 89 78(R)BILL ANALYSIS Senate Research CenterC.S.H.B. 89 By: McClendon (Barrientos) Government Organization 4/25/2003 Committee Report (Substituted) DIGEST AND PURPOSE C.S.H.B. 89 provides certain state employees who are donating an organ, bone marrow, or blood a paid leave of absence. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter Z, Chapter 661, Government Code, by adding Sections 661.916 and 661.917, as follows: Sec. 661.916. LEAVE FOR ORGAN OR BONE MARROW DONORS. (a) Entitles a state employee to a leave of absence without a deduction in salary for the time necessary to serve as a bone marrow or organ donor. (b) Prohibits the leave of absence provided by this section from exceeding a certain number of days. Sec. 661.917. DONATION OF BLOOD. (a) Requires a state agency to allow each agency employee sufficient time off, without a deduction in salary or accrued leave, to donate blood. (b) Prohibits an employee from receiving time off under this section unless the employee obtains approval from the employee's supervisor before taking time off. (c) Requires an employee, on returning to work after taking time off under this section, to provide the employee's supervisor with proof the employee donated blood during the time off. Requires the state agency, if an employee fails to provide proof the employee donated blood during the time off, to deduct the period for which the employee was granted time off from the employee's salary or accrued leave, whichever the employee chooses. (d) Authorizes an employee to receive time off under this section not more than four times in a fiscal year. SECTION 2. Effective date: September 1, 2003.
