SRC-JEC H.B. 146 78(R) BILL ANALYSIS Senate Research Center H.B. 146 78R1339 JRJ-DBy: Solomons (Estes) State Affairs 5/6/2003 Engrossed DIGEST AND PURPOSE Current law allows a citizen to be summoned for jury selection on election day. An individual who fails to appear for jury duty can be fined. H.B. 146 prohibits courts from summoning prospective jurors on the general election day. It does not prohibit the meeting of a jury in the process of a trial. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter A, Chapter 62, Government Code, by adding Section 62.0125, as follows: Sec. 62.0125. SUMMONS FOR JURY SERVICE ON GENERAL ELECTION DAY PROHIBITED. Prohibits the summons of prospective jurors to appear for jury service on the date of the general election for state and county officers. SECTION 2. Effective date: September 1, 2003.
