SRC-LBB H.B. 178 78(R) BILL ANALYSIS Senate Research Center H.B. 178 78R1089 EMT-DBy: Ellis,Dan (Staples) State Affairs 5/5/2003 Engrossed DIGEST AND PURPOSE Currently, Section 42.20(c) of the Code of Criminal Procedure states that certain officers receive indemnity in their functions as community supervision council members. For example, this article applies to a sheriff or employee of a sheriff's department, a county judge, county commissioner, or county employee, among others. H.B. 178 includes county attorneys, district judges, district attorneys and criminal district attorneys in the list of individuals to which Article 42.20(c) applies. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 42.20 (c), Code of Criminal Procedure, to include county attorneys, district judges, district attorneys and criminal district attorneys in the list of individuals to which Article 42.20(c) applies. Makes conforming changes. SECTION 2. Repealer: Section 8(g), Article 42.03, Code of Criminal Procedure, as redesignated and amended by Section 1, Chapter 201, 73rd Legislature, Regular Session, 1993. SECTION 3. (a) Effective date: September 1, 2003. (b) Makes application of this Act prospective.
