C.S.H.B. 208 78(R) BILL ANALYSIS C.S.H.B. 208 By: Puente Business & Industry Committee Report (Substituted) BACKGROUND AND PURPOSE Under current law, a person who performs labor or furnishes materials for, the demolition of property is not protected from non-payment for work performed. HB208 amends Section 53.021 of the Property Code by allowing a person to obtain a mechanic's lien on real property. Under written contract, the mechanic's lien would provide financial security for the person performing the work. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS HB208 amends the Property Code to include a person who performs labor, or furnishes labor or materials to demolish property to be entitled to a mechanic's lien. EFFECTIVE DATE September 1, 2003 COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B.208 differs from the original H.B.208 by including in Section 53.021 (e) lines 10-11 trustee, receiver, contractor, or subcontractor.
