SRC-TJG H.B. 254 78(R) BILL ANALYSIS Senate Research Center H.B. 254 78R2344 KCR-FBy: Kolkhorst (Armbrister) Criminal Justice 5/18/2003 Engrossed DIGEST AND PURPOSE H.B. 254 authorizes certain offenses relating to identity theft to be prosecuted in any county in which the offense was committed or in the county of residence for the person whose identifying information was fraudulently obtained, possessed, transferred, or used. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 13, Code of Criminal Procedure, by adding Article 13.28, as follows: Art. 13.28. FRAUDULENT USE OR POSSESSION OF IDENTIFYING INFORMATION. Authorizes an offense under Section 32.51 (Fraudulent Use or Possession of Identifying Information), Penal Code, to be prosecuted in any county in which the offense was committed or in the county of residence for the person whose identifying information was fraudulently obtained, possessed, transferred, or used. SECTION 2. Effective date: September 1, 2003. Makes application of this Act prospective.
