SRC-LBB H.B. 403 78(R) BILL ANALYSIS Senate Research Center H.B. 403 78R1401 JRJ-DBy: Madden (Madla) State Affairs 5/20/2003 Engrossed DIGEST AND PURPOSE Under current law, the penalty for releasing voting results before the polls close is a Class C misdemeanor. H.B. 403 raises the offense from a Class C misdemeanor to a Class A misdemeanor for premature disclosure of voting results. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 61.007(b), Election Code, to provide that an offense under this section is a Class A, rather than a Class C, misdemeanor. SECTION 2. (a) and (b) Make application of this Act prospective. SECTION 3. Effective date: September 1, 2003.
