H.B. 469 78(R) BILL ANALYSIS H.B. 469 By: Berman Public Education Committee Report (Unamended) BACKGROUND AND PURPOSE Current law allows a representative of an alternative education program be present at a hearing, which would place a child with a disability who has been expelled from a school, into an alternative education program. House Bill 469 extends this legislation until September 1, 2005. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 469 amends the Education Code to provide that subsections 37.004 (e) and (f) expire September 1, 2005 rather than 2003. EFFECTIVE DATE Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2003.
