SRC-AMY H.B. 552 78(R) BILL ANALYSIS Senate Research Center H.B. 552 78R1679 CAS-DBy: Hegar (Janek) Education 5/20/2003 Engrossed DIGEST AND PURPOSE Currently, a school district does not have the express written authority to expel a student who commits an expellable offense on school property in another school district or at a schoolsponsored event in another school district. H.B. 552 authorizes the school district in which the student attends to expel a student who engages in an expellable offense in another school district. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 37.007, Education Code, by adding Subsection (i), to authorize a student who engages in conduct described by Subsection (a) to be expelled from school by the district in which the student attends school if the student engages in that conduct on school property of another district in this state or while attending a school-sponsored or school-related activity of a school in another district in this state. SECTION 2. Provides that this Act applies beginning with the 2003-2004 school year. SECTION 3. Effective date: upon passage or September 1, 2003.
