H.B. 567 78(R) BILL ANALYSIS H.B. 567 By: Berman Public Education Committee Report (Unamended) BACKGROUND AND PURPOSE Currently a student may not be expelled from a public school for an offense committed off of school property or not at a school event. House Bill 567 would allow the option of expulsion for students who have committed a violent offense, even if the offense took place off campus. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 567 amends the Education Code to provide that a student may be expelled if the student engages in conduct that contains the elements of aggravated assault, sexual assault, aggravated sexual assault, murder, or criminal attempt to commit murder, whether or not the conduct occurred on or off school property. EFFECTIVE DATE Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2003.
