SRC-JEC H.B. 623 78(R) BILL ANALYSIS Senate Research Center H.B. 623 78R6180 MTB-DBy: Goolsby(Carona) Infrastructure Development and Security 4/17/2003 Engrossed DIGEST AND PURPOSE Current law allows a tax office in a county with a population over 2.8 million to regulate motor vehicle title services. A motor vehicle title service is any person who for compensation directly or indirectly assists other persons in obtaining title documents by submitting, transmitting, or sending applications for title documents to the appropriate government agencies. Regulation of motor vehicle title services in counties with high volume registration has proven helpful in preventing fraud. H.B. 623 expands the applicability of this provision to counties with a population over 500,000. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 520.052, Transportation Code, to provide that this subchapter applies to any motor vehicle title service operating in a county that has a population of more than 500,000, rather than 2.8 million. SECTION 2. Provides that a person required to hold a license under Subchapter E, Chapter 520, Transportation Code, as amended by this Act, in a county with a population 2.8 million or less, is not required to hold a license before October 1, 2003. SECTION 3. Effective date: September 1, 2003.
