SRC-AMY H.B. 673 78(R) BILL ANALYSIS Senate Research CenterH.B. 673 By: Madden (Shapiro) Education 5/18/2003 Committee Report (Amended) DIGEST AND PURPOSE In 2002, the United States Congress enacted the No Child Left Behind (NCLB) Act. That Act requires any school receiving federal Elementary and Secondary Education Act Title I, Part A funding to notify parents regarding teachers who do not meet the NCLB Act's definition of "highly qualified." Currently, the Texas Education Code essentially duplicates this requirement. H.B. 673 eliminates the requirement for duplicate notices. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 21.057, Education Code, by adding Subsection (e) to provide that this section does not apply if a school is required in accordance with the No Child Left Behind Act of 2001, and its subsequent amendments, to provide notice to a parent regarding a teacher who is not highly qualified, provided the school provides notice as required by that Act.
